OHIO BOARD HAS YET TO PROVIDE 2007 RECORDS IN RESPONSE TO JANUARY REQUEST

In January 2008, I requested the records of all vets disciplined in Ohio in 2007.  I received a letter from the Ohio Veterinary Board, dted January 25, stating the following:

"The Ohio Veterinary Medical Licensing Board ("Board") received your public records request January 23, 2008.  Unfortunately, you have made your request at a bad time as it is renewal time for the veterinarians and it takes priority.  Your request will be quite burdensome for a two person office and therefore, will not be able to be fulfilled in our usual timely fashion."

They went on to say: "Once the Board has determined what the costs will be, a notice will be provided." 

Well, I have yet to receive this "notice."

Is the Ohio Veterinary Board, by failing to provide me with the requested records, in violation of State regulations?

In their public records policy document, the Board says: "Inspection of public records must be made available promptly.  'Promptly' and 'reasonable period of time' take into account the volume of records requested, where the records are stored, and time for any legal review and/or redaction. Records prepared for inspection may be viewed during regular business hours. The Board will provide copies of public records on paper, on the medium on which they are kept, or on any other medium the office determines it reasonably can duplicate the records as an integral part of normal operations . .  . If a person believes this office has failed to comply with the Ohio Public Records Act, they may file a court petition in mandamus. The Board recognizes the legal and non-legal consequences of failure to properly respond to a public records request."

The following list of veterinarian's disciplined by the Ohio Veterinary Medical Licensing Board in the year 2005 was provided by the Board in response to a request from the Toonces Project.

PLEASE NOTE:  This is not a complete list of disciplined vets in Ohio.  If your vet's name does not appear on this list, it does not mean that she or he does not have a disciplinary record with the state.   To find out if your Ohio vet has a disciplinary record, you can either a) file a FOIA request with the Ohio Vet Board (www.ovmlb.ohio.gov); contact the Toonces Project at help@thetooncesproject.com to request assistance with filing said request. 

Also, be aware that the absence of a record with the state is no guarantee of quality or competent care.  Remember that the majority of complaints filed by pet owners are dismissed by Veterinary Boards.  Our review of many dismissed complaints leads us to believe that in many cases, even complaints that are dismissed present information that would cause any conscientious pet owner to be concerned about the care provided by the vet.  However, unfortunately, with the exception of a few states, complaints themselves are not available as public record.

Notes on Information provided to the Toonces Project by the State of Ohio:  The Board has initially provided copies of Settlement Agreements only.  These agreements do not contain any information about case details.  Obtaining case details will require an additional request.   We will make said request when time permits; we'd love some volunteer help with follow up!  If you can help us, contact us at help@thetooncesproject.com

Frizzell, David. Actions:  Settlement Agreement.  Terms:  "1. You entered the OPEP program by 5:00 p.m. October 28, 2005 to begin immediate treatment for alcohol dependency; 2.  You agree to abide by all terms of your agreement with OPEP and maintain treatment for the duration of your agreement; 3.  You agree to provide any such authorizations or written consent forms as needed for the Board to obtain reports regarding your treatment from OPEP; 4. You agree that should you fail to complete or participate in the OPEP program, your license to practice veterinary medicine will be suspended for six (6) months."

Hagely, James.  Actions:  Settlement Agreement.  Terms:  30-days suspension, 15 of which were "suspended" (i.e. stayed).  Probation for two renewal periods (2006/2008 and 2008/2010).  If license not renewed in timely fashion, 2-week suspension to be imposed.  Fine $2500.  Investigative Costs:  $189.16.  

Hall, Marcia.  Actions:  Settlement Agreement.  Terms:  Letter of Reprimand.  Fine $500.  Investigative Costs: Vet to pay one-half of investigative costs in the amount of $1,969.50.
